Terms of Service

These terms govern your use of Pharos, a product of Cognitech Business Intelligence ("Cognitech", "we", "us"), based in Guatemala. By using Pharos you accept these terms.

The service

Pharos generates a single marketing-analysis PDF report from a CSV or Excel file you upload. The report includes:

  • Structural audit of the provided data.
  • Calibrated channel-level analysis with confidence levels.
  • Industry-benchmark comparison from our curated corpus.
  • Narrative content generated by AI agents following explicit methodology rules.

Pharos is an analytical aid. It is not financial, accounting, tax, or business advice.

Price and payment

  • Price: $15 USD per report.
  • Payment is processed via Recurrente (a payment processor authorized in Guatemala).
  • We accept card (Visa, Mastercard) and bank transfer.
  • Payment is one-time, per report. There are no subscriptions, recurring charges, or auto-renewals.

Refund policy

  • Full refund within 7 days if the report was not delivered correctly due to a Pharos technical failure.
  • No refund if you received the PDF and simply didn't like the analysis conclusions. The analysis is calibrated and honest; we do not guarantee favorable findings.

Limitation of liability

Pharos generates analysis based on the data you provide. We:

  • Do not guarantee findings are exhaustive.
  • Are not liable for business decisions made based on the report.
  • Are not liable for errors in the source data or interpretations you draw from the report.

Our maximum liability to you, under any circumstance, is limited to the amount paid for the specific report in dispute ($15 USD).

Intellectual property

  • Your data: you retain all rights to the marketing data you upload. We have a limited license to process it solely to generate your report.
  • Your report: you receive rights to use it internally, share with your team, and cite in presentations. You may not resell or commercially redistribute it.
  • Pharos methodology and corpus: are property of Cognitech. You may not copy, redistribute, or use them to build competing services.

Acceptable use

By using Pharos you commit to:

  • Not uploading false, manipulated, or third-party data without authorization.
  • Not using Pharos for scraping, reverse engineering, or service attacks.
  • Not reselling reports without our written authorization.
  • Not using Pharos for illegal analyses or those that infringe third-party rights.

We reserve the right to suspend service to any user who violates these terms.

Service availability

We strive to keep Pharos available 24/7, but we do not guarantee uninterrupted availability. Maintenance windows, third-party provider failures (Modal, Supabase, Recurrente, OpenAI, Anthropic, Resend) may cause interruptions. If an interruption prevents your report generation, our refund policy applies.

Modifications

We may modify these terms at any time. For material changes we will notify active customers by email at least 14 days in advance. Continued use of the service after the change constitutes acceptance.

Jurisdiction

These terms are governed by the laws of the Republic of Guatemala. Any dispute will be resolved in the competent courts of Guatemala City, waiving any other jurisdiction that might apply.
